BEFORE: JONES and KRUPANSKY, Circuit Judges; and SPIEGEL, District Judge* Order Plaintiff-Appellant, Ralph Caudill (Caudill) appeals from an order of the District Court for the Eastern District of Kentucky affirming the decision of the Secretary of Health and Human Services (Secretary) denying Black Lung Benefits. This Court has meticulously reviewed the record in the instant matter and has carefully listened to the statements of counsel at oral argument. Upon due consideration, the Court concludes that the Secretary's decision is not supported by substantial evidence. Accordingly, the decision of the district court is hereby REVERSED and REMANDED with instructions that the matter be further remanded to the Secretary for an award of benefits.
